Welcome to Boundless Software. These Terms describe use of our marketing website. The website provides information and accepts inquiries and webinar registrations; it does not create a paid account, subscription or payment obligation. Purchased products and professional services are governed by the applicable written service agreement, which controls where its terms differ from this website notice.
1. Acceptance of Terms
By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.
These Terms apply to all users of our services, including visitors, customers, and contributors of content, information, and other materials or services.
2. Description of Services
Boundless Software provides a comprehensive suite of AI-powered infrastructure products and professional services, including but not limited to:
- Teleplex: An AI Avatar platform for persistent customer conversations.
- Anvil: AI-native orchestration for workflow automation and enterprise integration.
- Switchblade: Kubernetes operator for automated infrastructure management.
- BRYCK Edge AI: Edge computing platform for latency-critical, air-gapped deployments.
- Professional Services: Cloud Migration, Cloud Security, AI Middleware, and Digital Transformation consulting.
Changes to paid services follow the notice and other obligations in the applicable written service agreement.
3. User Obligations and Account Security
Provide accurate inquiry information and submit only information you are authorized to share. This website has no self-service account registration. If you receive credentials for a separately contracted service, protect them and report suspected unauthorized access under that service agreement.
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our servers or networks.
4. Privacy and Data Protection
Our Privacy Policy describes this website’s inquiry forms, optional analytics and privacy request routes. Product-specific processing obligations and applicable data protection laws depend on the service, agreement and jurisdiction.
Discuss any required data processing agreement or sector-specific terms with us before submitting regulated information or using a product for that purpose.
5. Intellectual Property Rights
Website content, graphics, logos and software belong to Boundless Software or their respective licensors and owners. Applicable copyright, trademark and other intellectual property rights remain with those owners.
You retain all rights to your data and content. By using our services, you grant us a limited license to use, store, and process your content solely for the purpose of providing our services to you.
6. Service Modifications and Availability
Website information, features and displayed pricing may change. Availability commitments, notice requirements and service levels for paid services are only those in the applicable written agreement.
While we strive to ensure our services are always available, we cannot guarantee uninterrupted access and shall not be liable for any loss or damage resulting from service interruptions.
7. Payment Terms
The marketing website does not collect payments. The following describes possible billing models; actual fees, taxes and payment terms require the applicable written service agreement:
- Usage-based billing: Anvil charges are calculated per-minute or per-execution based on your usage.
- Subscription billing: Teleplex offers monthly and annual subscription tiers with different feature sets.
- Service agreements: Professional services are billed according to custom invoicing terms specified in your service agreement.
All fees are exclusive of taxes, and you are responsible for all applicable taxes and government charges.
8. Limitation of Liability
To the maximum extent permitted by law, Boundless Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your access to or use of or inability to access the Service
- Any conduct or content of any third party
- Any content obtained from the Service
- Unauthorized access, use, or alteration
In no event shall our total liability exceed the amount paid by you to Boundless Software in the twelve (12) months preceding the claim.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms shall be resolved through binding arbitration in Toronto, Ontario, in accordance with the rules of the ADR Institute of Canada. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.
10. Acceptable Use and AI Avatar Permissions
Do not use the website or inquiry forms for fraud, harassment, malware, unauthorized access, unlawful activity or infringement of others’ rights. AI Avatar and voice or likeness use requires the necessary rights and informed consent from the person represented. Do not impersonate another person deceptively, create unauthorized replicas, or present generated content as a person’s actual statements without permission. Product-specific safeguards and permitted uses must also follow the applicable service agreement.
11. Termination and Deletion
You may stop using the website at any time. We may restrict abusive or unlawful website access. Contact info@boundless.software to withdraw an inquiry or request deletion of personal information, subject to applicable legal and contractual retention requirements. Cancellation, termination, data export and deletion for paid services follow the applicable written service agreement; sending a website inquiry does not establish a paid service.
12. Third-Party Services and Force Majeure
Forms, external resources and linked services are operated by third parties and may be unavailable or change. Their terms and privacy notices apply to their processing. Disruptions outside reasonable control can affect access; any force majeure relief, notice obligations and remedies for paid services are determined by the applicable written service agreement and law.
13. Indemnification and Service Agreements
Any indemnification obligation for a paid product or service is limited to what is provided in the applicable written service agreement and permitted by law. This website notice does not create a separate, unlimited indemnity. Nothing here removes rights that cannot lawfully be excluded. Contact us to obtain and review the applicable agreement before purchasing a service.
